TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of Work, a mobile application and related services (collectively, the “Service”). In these Terms, “Work,” “we,” “us,” and “our” refer to the operator of the Service.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 9 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms.

3. The Service

Work is a community-driven platform that helps users discover cafes, libraries, and other places to work or study, and share information such as check-ins, crowd levels, noise levels, amenities, and photos.

No reliance. The Service is informational and community-sourced. Do not rely on Work for safety-critical decisions, emergencies, or time-sensitive accuracy.

4. Account Registration and Security

To access certain features (including posting content or check-ins), you may need to create an account. You agree to:

  • Provide accurate information and keep it current

  • Maintain the confidentiality of your credentials

  • Notify us promptly of unauthorized access or security issues

You are responsible for all activity that occurs under your account.

5. User Content and License

User Content includes any text, photos, check-ins, reviews, ratings, comments, or other material you submit through the Service.

Ownership. You retain ownership of your User Content.

License to Work. By submitting User Content, you grant Work a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting and display), distribute, publicly display, and otherwise use your User Content in connection with operating, improving, promoting, and providing the Service.

Your representations. You represent and warrant that:

  • You own or have all necessary rights to submit the User Content, and

  • Your User Content does not violate any law or any third-party rights (including privacy, publicity, copyright, or trademark rights).

6. Content Rules (Prohibited Conduct)

You agree not to:

  • Post false, misleading, or deceptive information (including fake check-ins)

  • Harass, threaten, or abuse others, or post hateful or discriminatory content

  • Post illegal content or encourage illegal activity

  • Post spam, manipulate rankings or rewards, or coordinate fraudulent engagement

  • Attempt to reverse engineer, scrape, disrupt, or overload the Service

  • Circumvent moderation systems, safety features, or access controls

  • Use the Service in violation of applicable laws

We may remove content, reduce visibility, or take other enforcement actions at our discretion.

7. Moderation and Enforcement

Work may (but is not obligated to) review, remove, edit, block, or restrict User Content, and suspend or terminate accounts for any reason, including violations of these Terms, risk to users, or legal or compliance requirements.

8. Intellectual Property

The Service, including its software, design, trademarks, logos, and branding, is owned by Work and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.

9. Third-Party Services and Links

The Service may integrate or link to third-party services (such as hosting providers, analytics, maps, or authentication tools). Work is not responsible for third-party services, and your use of them may be governed by their own terms and policies.

10. Location Features

If you enable location permissions, the Service may use your device’s location to show nearby places and support location-based check-ins. You can disable location permissions at any time in your device settings, though some features may not function properly.

11. Account Deletion

You can initiate account deletion within the app (or through the method described in-app). We will process deletion in accordance with our Privacy Policy and applicable law.
Apple requires apps that support account creation to also support in-app account deletion initiation.

12. Termination

We may suspend or terminate your access to the Service at any time. You may stop using the Service at any time and request account deletion.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the maximum extent permitted by law, Work disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy, completeness, or reliability of user-submitted information, including crowd levels, hours, amenities, or availability.

14. Limitation of Liability

To the maximum extent permitted by law, Work will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, or revenue arising out of or related to your use of the Service.

In no event will Work’s total liability exceed the greater of (a) $100 or (b) the amount you paid Work (if any) in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Work and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms.

16. Changes to the Service or Terms

We may modify or discontinue the Service at any time. We may update these Terms from time to time. If changes are material, we will provide reasonable notice (such as an in-app notice). Continued use after the effective date means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of California, excluding conflict-of-law principles, except where prohibited by law.

18. Apple iOS Additional Terms

If you use the Service on iOS:

  • These Terms are between you and Work, not Apple

  • Apple has no obligation to provide maintenance or support services

  • Apple is not responsible for claims relating to the Service, including product liability, legal compliance, or consumer protection claims

  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them

20. Promotions, Rewards, and Verification

Work may offer promotions, rewards, sweepstakes, challenges, or other incentive programs (“Promotions”), including in partnership with third-party venues (“Partner Venues”). Promotions may be subject to additional rules presented in-app.

Eligibility and limits. Promotions may be limited by time, geography, quantity, account, device, or venue. Rewards have no cash value unless explicitly stated and may be revoked for violations.

Verification. To prevent fraud, Work may require verification methods such as QR codes, rotating codes, or location confirmation. Attempts to falsify participation may result in forfeiture of rewards and account suspension or termination.

Partner fulfillment. Rewards offered by Partner Venues are fulfilled solely by the Partner Venue. Work is not responsible for a Partner Venue’s refusal to honor a reward due to fraud concerns or operational constraints.

Taxes. You are responsible for any taxes or reporting obligations related to rewards.
